Winter Sale 2023 promotion
1. These terms and conditions ("Terms") apply to this Winter Sale 2023 promotion ("Promotion"). By taking part in the Promotion, you agree to be bound by these Terms. It is a condition of participation in the Promotion that all Terms are accepted as final.
2. This Promotion is organised by Pan Jewelry Limited, registered in the Republic of Ireland at 87 Grafton Street, Dublin, D02 KP49, Ireland, company no. 618484 ("Pandora", “us”, “our”).
3. By participating in this Promotion, you also agree to be bound by the general terms and conditions on the Pandora website at https://ie.Pandora.net/ ("Pandora Website"). By participating in this Promotion through Participating Stores, you also agree to be bound by the terms and conditions at that store. If there is a conflict between these Terms and any of the other terms and conditions mentioned above, these Terms will take priority.
Further details of the Promotion
4. This Promotion runs from 2nd January (or from 1st January 5am for Club members only), and continues until and only whilst stocks last (“Promotional Period”).
5. This Promotion is available, subject to availability and while stocks last, through:
· the Pandora Website; and
· participating Pandora concept stores and authorised Pandora stockists in Republic of Ireland only, during their stated trading hours, excluding discounted items in all outlets ("Participating Stores").
This Promotion is not valid in stores in, or for delivery to, the UK or elsewhere outside the Republic of Ireland.
6. This Promotion is open to members of the public, who are at least 16 years of age, which can include employees of Pandora and Pandora franchisees and members of their families and households ("Eligible Participants").
7. Eligible Participants will be entitled to a discount of up to 50% on full price selected products from a Participating Store or the Pandora Website during the Promotional Period ("Qualifying Purchase") and those who make a Qualifying Purchase will receive a voucher for 15% off full price charms, clips and safety chains (redeemable by Pandora Club members only between 1st to 31st January 2024 (inclusive), subject to exclusions in term 12) (“Voucher”).
8. The Promotion is not valid in conjunction with any other online or in-store offer, promotion or voucher unless stated.
9. All item(s) forming part of the Qualifying Purchase must be purchased in one transaction (with one single delivery selected where delivery is required).
10. There is no cash alternative to the discount or Voucher. The discount and Voucher is not exchangeable for cash or for any other Pandora product or service.
11. Additional terms may apply for refunds and exchanges in accordance with the other terms and conditions mentioned at Term 3.
12. The Voucher is not redeemable on sale and outlet products, Build a Bracelet & Build a Pendant offers, Pandora Lab-Grown Diamonds collection, 14k gold Items, Game Of Thrones collection, engravable products and engraving services, UNICEF products, discounted gift sets, or shipping costs. The Voucher is not valid in conjunction with any other online or in store offer, promotion or voucher unless stated.
13. A limit of one Voucher per transaction applies. For the avoidance of doubt, if an Eligible Participant makes multiple Qualifying Purchases in a single transaction, they would not be entitled to any more than one Voucher.
14. The Voucher may only be redeemed once and will not be re-issued if the product(s) the discount was spent on is returned.
15. The Voucher must be redeemed in full in one single transaction.
Other important terms
16. This Promotion is subject to stock availability and, whilst reasonable efforts have been made to ensure sufficient stocks are available to meet likely demand, Pandora may suspend or end the Promotion early on the Pandora Website or in any one or more Participating Store without notice if, in the opinion of Pandora, there is not sufficient stock to continue operating the Promotion.
17. Pandora reserves the right to cancel the Promotion or amend the Terms without notice in the event there is any actual or anticipated breach of any applicable law or any other event outside Pandora's reasonable control.
18. Pandora and a Participating Store reserve the right to not award a discount or Voucher, or disqualify a participant or ask a participant to leave a Participating Store if there are reasonable grounds to believe that any person is not eligible or for any other lawful reason, including unruly behaviour or failure to comply with these Terms.
19. Any attempt to deliberately undermine the legitimate operation of this Promotion may be a violation of criminal and/or civil laws and, should such an attempt be made, Pandora reserves the right to seek remedies and damages to the fullest extent permitted by law.
20. This Promotion and these Terms will be governed by Irish law and, subject to any right you may have as a consumer to select jurisdiction, any disputes will be subject to the jurisdiction of the Courts of the Republic of Ireland. This Promotion and any website or location on which these Terms are posted are only intended to be accessed from the Republic of Ireland. Pandora does not make any representation that materials relating to this Promotion are appropriate or available for use in other territories. Access to this Promotion from territories where its contents are illegal is strictly prohibited. If you view these Terms from other territories then you are responsible for compliance with local laws.
Liability
21. Subject to Terms 26 and 27, Pandora accepts no responsibility for any damage, loss, injury or disappointment suffered by any person as a result of their participation in this Promotion, their attempted participation or their acceptance of any product.
22. By participating or attempting to participate in this Promotion, participants agree that Pandora shall not bear any liability for:
(a) the loss, theft or misuse of any product; or
(b) any damage in any way attributable to this Promotion or the attempted participation in this Promotion, subject to Terms 26 and 27.
23. Nothing in these Terms shall exclude Pandora's liability for death or personal injury as a result of its negligence, or for fraud or fraudulent misrepresentation, or for any other liability which may not be lawfully limited or excluded.
24. Nothing in these Terms shall affect any participant's legal rights including all rights in respect of refunds, replacements and repairs for products which are faulty, not fit for purpose or not as described.
25. Any failure on any occasion by Pandora to enforce a Term is not a waiver of that Term.
26. In the event of any dispute regarding the Terms or the conduct of this Promotion, the decision of Pandora shall be final and no correspondence or discussion shall be entered into.
